Patent Regulations, 1996 (LI 1616)

Section 8: (1) The applicant shall, at the request of the Registrar, furnish the Registrar with the date and number of any foreign application. (2) The applicant shall, at the request of the Registrar, furnish the Registrar with the following documents relating to any of the foreign applications referred to in subsection (1) (a) a copy of any communication received by the applicant concerning the results of any search or examination carried out in respect of the foreign application; (b) a copy of the patent granted on the basis of the foreign application; (c) a copy of any final decision rejecting the foreign application or refusing the grant requested in the foreign application. (3) The applicant shall, at the request of the Registrar, furnish the Registrar with a copy of any final decision invalidating the patent granted on the basis of the foreign application referred to in subsection (2). (4) For the purposes of this section "foreign application" means any application filed by the applicant abroad which relates to the same or essentially the same invention as that claimed in the application filed with the Patent Office.

Procedures to Follow

  • A Patent application is filed with the prescribed fees which must contain: a description, claims, abstract or drawings where applicable
  • The application is acknowledged with a filing date and application number
  • Power of attorney if applicable; where applicant is a foreigner or foreign entity based outside the jurisdiction
  • Formality examination is conducted by the Patent Registry to ensure that all the formal requirements in respect of fees and information required are provided
  • A Search and Substantive examination is subsequently conducted for the invention claimed in the application/ request
  • The application is Refused where it does not meet the patentability requirement as provided by the Patent Act
  • The application is Granted where it meets the patentability requirement in accordance with the Patent Act
  • The application is Published in the Industrial and Commercial Bulletin
  • A certificate is issued for the patent
  • In order to maintain the patent or patent application, an annual fee shall be paid in advance to the Registrar for each year, starting one year after the filling date of the application
