Trademarks Regulations, 1970 (L.I. 667)

Regulation 55:(1) Before exercising adversely to any person any discretionary power given to the Registrar by the Act or by these Regulations, the Registrar shall if so required hear such person thereon.(2) An application for a hearing shall be made within one month from the date of notification by the Registrar of any objection to an application or the date of any other indication that he proposes to exercise a discretionary power.(3) Upon receiving such application the Registrar shall give the person applying ten days' notice of a time when he may be heard. Within five days from the date when such notice would be delivered in the ordinary course of post the person applying shall notify the Registrar whether or not he intends to be heard on the matter.(4) The hearing before the Registrar of any dispute between two of more parties relating to any matter in connection with a registered trade mark or an application to register a trade mark shall be in public unless the Registrar, after consultation with those parties to the dispute who are represented at the hearing, otherwise directs.(5) The decision of the Registrar in the exercise of any such discretionary power as aforesaid shall be notified to the person affected.
