Ghanaian Enterprises Development Act, 1975 (N.R.C.D. 330)Section 3C (1): The Board may review a transaction entered into by a person, whether made before or after the commencement of this Act, in respect of a specified enterprise and may by writing, set aside the transaction if it is satisfied that the transaction has been entered into with the intention of defeating the objects of this Act or of the Ghana Investment Promotion Centre Act, 1994 (Act 478).13(13)(2) A person aggrieved by a decision of the Board under subsection (1) may, within fourteen days after being notified of the decision, appeal against it to the Minister.(3) The Minister may confirm, reverse or vary the decision of the Board.14(14)(4) Without prejudice to the generality of subsection (1), the Board may set aside a transaction under that subsection entered into on or after the 1st day of January, 1973 for the purpose of ensuring equitable distribution of the wealth of Ghana. |
