Natural Gas Pipeline Safety (Construction, Operation And Maintenance) Regulations, 2012 (L.I. 2189)Regulation 68—Offences and penalties(1) A person that(a) willfully interferes or knowingly permits the interference with an offshore gas gathering line; or(b) willfully and knowingly injures, destroys or attempts to injure or destroy a transmission facility or pipeline facility,commits an offence and is liable on summary conviction to a fine of not less than one thousand penalty units and not more than five thousand penalty units or to a term of imprisonment not less than four years and not more than ten years or to both the fine and imprisonment on first conviction, and to a fine of not less than two thousand penalty units and not more than ten thousand penalty units or to a term of imprisonment of not less than eight years and not more than twenty years or to both that fine and imprisonment on a subsequent conviction.(2) A person who willfully and knowingly, defaces, damages, removes or destroys a pipeline sign, right of way marker, or marine buoy commits an offence and is liable on summary conviction to a fine of not more than two thousand penalty units or to a term of imprisonment of not more than five years or to both.(3) Where the offence under subregulation (2) is continuous, the person who commits the offence is liable on summary conviction to a further fine of two hundred and fifty penalty units for each day during which the offence continues after written notice has been served on the offender by the Commission.(4) Where a person(a) fails to comply with an obligation imposed under these Regulations, that person is liable to pay compensation for the damage resulting from the noncompliance to the satisfaction of the court; or(b) contravenes a provision of these Regulations for which a penalty is not provided, that person commits an offence and is liable on summary conviction to a fine of not more than two hundred and fifty penalty units or to a term of imprisonment of not more than twelve months or to both. |
