Natural Gas Pipeline Safety (Construction, Operation And Maintenance) Regulations, 2012 (L.I. 2189)Regulation 7—Application to construct or operate a pipeline (1) A person shall not commence the construction, installation, operation or modification of a pipeline without the prior written approval of the Commission.(2) A person who intends to construct or operate a pipeline shall apply to the Commission in the form determined by the Board and accompanied with(a) the design duly verified by a reputable third party, and(b) other documents and fees determined by the Board.(3) The Commission shall(a) within ten working days of the receipt of an application acknowledge receipt, and(b) within sixty days after the ten days inform the applicant in writing of the decision of the Board. (4) Subject to the Energy Commission Act, 1997 (Act 541), the Commission shall grant the authorisation to construct or operate a pipeline unless there is a reason founded on technical data, national security, public safety or other reasonable justification, which shall be communicated to the applicant.(5) The Commission may for stated reasons modify, suspend or cancel the authorisation, which has been granted only after it has considered any representation or objection made by the applicant. |
