Natural Gas Transmission Utility (Standards of Performance) Regulations, 2008 (L.I. 1936)Regukation 9 Administration Application for reserve capacity 9. (1) A person may apply to the Utility for reserve capacity at an entry point. (2) The Utility may reject an application if (a) the applicant is not registered by the Commission as a shipper; (b) the applicant has not made any prior arrangement to make gas available at the entry point for the duration for which the capacity is required; (c) the quality of gas to be delivered at the entry point does not meet the requirement of the Utility at that entry point; or (d) for any other reason that the Utility determines. (3) The Utility shall (a) within ten days after the receipt of an application, acknowledge receipt, and (b) within sixty days after receipt of an application inform the applicant in writing of its decision. (4) Subject to regulation 4, where the Utility approves an application for reserve capacity, the Utility shall provide the shipper with the reserve capacity. (5) A person aggrieved by the refusal of the Utility to grant reserve capacity, may lodge a complaint with the Minister within ten days after receipt of the Utility's decision referred to in sub regulation (3) (b). (6) The Minister shall within thirty days after receipt of the com plaint make a decision on it. |
