Regulation 129(1) Regulation 128 does not apply to a newly opened mine which employs not more than thirty persons underground at any one time for the purpose of(a) making a communication between two or more shafts, adits, tunnels or outlets in any new developing mine; or(b) the interruption of ingress or egress or of communication within the mine workings as a result of an accident or dangerous occurrence.(2) The Chief Inspector may by order in writing, and on the conditions that are specified in the order, exempt a mine which was operating before the commencement of these Regulations from the provisions of regulation 128.
