Minerals And Mining (Health, Safety And Technical Regulations, 2012) (L.I. 2182)Regulation 41(1) The manager of a mine is responsible for an accident caused by the incompetence or inexperience of a workman employed in dangerous work in the mine, unless the manager can prove that proper precautions were taken by the manager.(2) Where an accident results in injury to a person because of that person's illegal activity in or in relation to a mine, or prospecting area the manager of the mine, or prospecting area is not responsible for the injury, if the manager has taken reasonable steps to curb the illegal activity. |
