Minerals And Mining (Health, Safety And Technical Regulations, 2012) (L.I. 2182)Regulation 21(1) Where an inspector has reasonable grounds to suspect that a person in a mine or engaged in a prospecting operation(a) is contravening any provision of these Regulations; or(b) has contravened any provision of these Regulations in circumstances that make it likely that the contravention will continue or be repeated; or(c) is involved in an activity or a practice which is dangerous, the inspector may give an improvement notice as set out in Form Two of the First Schedule to the holder or the manager of the mine which requires that person to take the necessary remedial action.(2) An improvement notice shall(a) state the grounds for the notice, which shall be reasonable;(b) specify the respective provisions of these Regulations which have been contravened;(c) state the action required to remedy the situation;(d) state the time by which the manager is required to remedy the matter or activity; and(e) state the right to have the notice reviewed in accordance with regulation 4.(3) A holder or the manager of a mine, who is given an improvement notice; and who fails to comply with the notice within the time specified in the notice, is liable to pay to the Commission in the first instance a penalty of not more than ten thousand United States dollars and to a further penalty of two hundred United Sates dollars for each day that the notice is not complied with.(4) Where an improvement notice is complied with, the manager of the mine shall give written notice of the compliance as soon as practicable after the compliance to the inspector who issued the notice; or if that inspector is not available at the relevant time, to the office of the Inspectorate Division.(5) A holder or the manager of a mine who fails to submit a written notice of compliance where that holder or manager is required to do so is liable to pay to the Commission in the first instance a penalty of not more than ten thousand United States dollars and to a further penalty of two hundred United States dollars.(4) Where an improvement notice is complied with, the manager of the mine shall give written notice of the compliance as soon as practicable after the compliance to the inspector who issued the notice; or if that inspector is not available at the relevant time, to the office of the Inspectorate Division.(5) A holder or the manager of a mine who fails to submit a written notice of compliance where that holder or manager is required to do so is liable to pay to the Commission in the first instance a penalty of not more than ten thousand United States dollars and to a further penalty of two hundred United States dollars. |
