Minerals and Mining (Licensing) Regulations 2012 (LI 2176)

Regulation 206(1) In accordance  with section  15(5) of the Act, where an application for a small scale mining licence conflicts with an existing mineral right for a different  mineral  in the same area,  the District  Office of the Commission  shall give notice  to the existing holder  within  fifteen days of the application,  as set out in Form Five of the First Schedule and the existing holder  shall be given the first option  to add the mineral  to the existing  mineral  right.(2) A notice under subregulation  (1) shall contain  particulars  of the mineral and the area applied for, and shall require the existing holder to exercise the option by giving notice to the District Office of the Commission in writing  of the option  within  fifteen days after the notice.(3) Where  the existing  mineral  right holder  exercises the option to add the new mineral  within  the prescribed  time, the application  shall be rejected without  a refund  of the fees paid by the applicant.(4) Where the existing mineral right holder chooses not to exercise the option or does not exercise the option within  the prescribed  time, the new application  shall be accepted and processed in accordance  with these Regulations.

Procedures to Follow

Submit Your Application
Once you have filled and gathered all the required documents you will have to submit it at the district office.
It takes 5 days to review the application. The next 5 days is for notification of errors.
Submission To Mineral Titles Department (MTD)
10 days after registration, the district office shall submit the application to MTD.
MTD review the application in 10 days and records it in the priority register 
MTD Publishes In The Gazette
15 days after recording, MTD publishes in the gazette, notify chiefs, traditional authorities etc. through the Commission's District Offices. 
Application Dossier
Within
ten (10) days after publication, District Office shall submit application dossier to MTD for appropriate recommendation to Minister
Minister Takes Decision
Once you have completed these steps you are ready to start your business.
You need to renew your license every three (3) years.
Approval / Rejected
21 days notification to applicant and Fees payable if approved.
Reasons are given if rejected. 
Applicable Fees
Within 60 days, applicant pays applicable fees and gives notice of acceptance of the grant to Minister and Commission in writing. 
License
Minister on proof of payment of applicable fees, issues licence to applicant within 30 days after the date of acceptance of the grant.
