Minerals and Mining (Licensing) Regulations 2012 (LI 2176)Regulation 87(1) Where a reconnaissance licence is terminated,(a) the rights of the holder shall cease but without prejudice to the liabilities or obligations incurred by the holder or the holder's representative in relation to the licence before the date of termination;(b) the Commission shall record the details of the termination in the General Register and delete the polygon corresponding to the licence from the cadastral map; and(c) the former holder shall be required by notice as set out in Form Twenty-Three of the First Schedule, to deliver in hard copy and in electronic form to the Commission within twenty-one days,(i) the records and samples which the holder is required to maintain under the Act or these Regulations;(ii) plans and maps of the area subject to the licence prepared by the holder or on the holder's instructions; and(iii) any other documents relating to the licence.(2) A person who fails to deliver a document or sample under subregulation (1)(c), within thirty days from the date of being given notice by the Commission is liable to pay to the Commission a penalty of not more than ten thousand United States dollars in the first instance and a further penalty of one thousand United States dollars for each day that the document or sample remains undelivered. |
