Minerals and Mining (Licensing) Regulations 2012 (LI 2176)Regulation 106(1) The Mineral Titles Department of the Commission shall within five days after recording an application in the General Register review the application to ensure that(a) the area applied for is correctly identified and the co-ordinates supplied are consistent with the geographic and geometric rules prescribed in these Regulations;(b) the application was submitted at least ninety days before the expiration of the licence;(c) the expenditure proposed in the work programme is in accordance with the minimum expenditure requirement specified in regulation 4(2);(d) the documentation required is complete and valid;(e) the area applied for does not exceed half of the existing number of blocks except where the number of blocks is not more than one hundred and twenty five;(f) the applicant has complied with the activities and expenditure in the work programme approved under the current licence; and(g) the applicable fees have been duly paid by the applicant.(2) Where an application does not comply with the provisions in subregulation (1), the Commission shall give notice accordingly to the applicant within five days after the review, as set out in Form Three of the First Schedule and the applicant shall correct the errors or provide the information required within ten days from the date of notification. |
