Minerals and Mining (Licensing) Regulations 2012 (LI 2176)Regulation 4(1) Application fees and fees that relate to mineral rights and other matters are payable as specified in the Second Schedule.(2) For the purpose of these Regulations, the minimum expenditure required to be incurred by a holder in an operation under a reconnaissance or prospecting licence for each cadastral unit or twenty-one hectares, is ten times the value of the annual mineral right fees as specified in the Second Schedule.(3) An annual mineral right fee payable under these Regulations shall be paid not later than ninety days before the expiration of each anniversary of the mineral right.(4) A fee, expenditure or other payment required to be paid or made under these Regulations and which is not yet paid or made within the period specified in sub regulation (3) shall be a debt owed to the Republic and recoverable by the Commission from the holder in Court.(5) Where a fee, expenditure or other payment required to be paid or made under these Regulations is not paid or not made within the stipulated period, the mineral right shall be terminated.(6) Despite the provision in these Regulations for rejection of an application in relation to a mineral right made later than the specified period, the Commission may, subject to reasonable explanation provided by the applicant, accept an application made after the specified period but not later than ten days before the expiration of the mineral right.(7) An application accepted under sub regulation (6) is subject to the payment of fees as specified in the Second Schedule. |
