Section 42: (I) The Minister shall not reject an application for a mining lease made under this Act.(0) unless the concerns of the Minister have been conveyed in writing to the applicant and the applicant has been given an opportunity to make appropriate amendments to the application or to the proposed pro¬gramme of mineral operations and has within a reasonable time that the Minister maypel1l1it, failed to do so, or(h) on the grounds that the applicant is in default, unless the Minister has given the applicant notice of the default and the applicant ha:;; failed within a reasonable time that may be specified in the notice to remedy the default.(2) A dispute between the Minister and an applicant in respect of a matter that arises under subsection (1) shall be referred for resolution under section 27.
