Regulation 43(1) An approved trustee of an employer sponsored scheme shall ensure that the independent trustee of the scheme is, as far as reasonably practicable, present at meetings of the trustees. (2) Where a decision is taken at a meeting of the trustees at which the independent trustee is absent, the minutes of the meeting shall be given to the independent trustee within seven days after the meeting and the independent trustee shall within seven days after receipt of the minutes acknowledge in writing, acceptance of the decisions taken at the meeting.(3) Where the independent trustee does not agree with a decision in respect of matters involving investment of scheme assets or matters that are prejudicial to the interest of scheme members, the independent trustee shall report the matter to the Authority.
