Occupational And Personal Pension Schemes (General) Regulations, 2011 (LI 1990)Regulation 128(1) Where a member of a registered scheme dies, a personal representative of the member may lodge with the approved trustee of the scheme a claim for payment of the member's accrued benefits. (2) The claim shall be in a form specified or approved by the Authority. (3) A claim made by a person who has been nominated or purports to be the personal representative of the relevant scheme member shall be accompanied by letters of administration, probate or any other relevant document. (4) Where there are no personal representatives of the member's estate, or if they are unwilling to act, the trustee may treat the member's accrued benefits as unclaimed benefits. |
