Occupational And Personal Pension Schemes (General) Regulations, 2011 (LI 1990)

Regulation 136(1) Where a member of a registered scheme or any other person has lodged a claim with the approved trustee of the scheme for the payment of the member's accrued benefits and the trustee is satisfied that the member or other person is entitled to be paid the accrued benefits but cannot locate that person the trustee shall take the steps specified in the Guidelines, within thirty days after the trustee becomes aware that the member or person cannot be located. (2) Where the trustee cannot locate the claimant within six months the accrued benefits shall be regarded as unclaimed benefits at the end of that period. (3) Where the trustee sends a cheque (a) to a claimant in respect of the payment of a scheme member's accrued benefits but the claimant does not present the cheque for payment within the period specified in the Guidelines; and (b) the trustee is unable to locate the claimant during the period of six months after the expiry of the period specified in the Guidelines, the accrued benefits shall be regarded as unclaimed benefits at the end of the six-month period.
