Regulation 38 (1) Where a member or the surviving beneficiaries of a deceased member, entitled to pension or refund under the Act or these Regulations is (a) a minor; (b) of unsound mind; or (c) suffering from a disability that renders the person unfit to manage the personal affairs, anything required to be done by that person may be done on behalf of the person by a person appointed by an order of a High Court or any other court of competent jurisdiction. (2) An amount payable to the person may be paid to the other person appointed to administer the personal affairs of the person in accordance with the order of the court. (3) Where a person is not appointed under sub-regulation (1) the Director-General may pay a benefit to a person determined by the Director-General as entitled to the payment and who will use the money for the maintenance and benefit of the minor or disabled person.
