Compensation for loss of appliance or record seized 19. (1) Where an enforcement authority exercises power under these Regulations to seize and detain any appliance or record, the enforcement authority shall be liable to pay compensation to any person who has an interest in the appliance or record for any loss or damage caused by the exercise of the power if (a) there has been no contravention of these Regulations in relation to the appliance or record; and (b) the exercise of the power is not attributable to the neglect or default by that person.(2) A dispute as to the right to or the amount of compensation payable shall be determined by arbitration at the first instance.
